§ 1 Scope

These Terms of Use apply to the use of the website swadn.com and the services offered through it by SWADN GmbH, Friedrich-Ebert-Anlage 36, 60325 Frankfurt am Main (“SWADN”). By registering, the user agrees to these Terms.

§ 2 Description of the service

SWADN provides an AI-assisted platform for personalised dietary recommendations. The service is in an early-access phase (beta). SWADN reserves the right to change, extend or discontinue features at any time.

The recommendations do not replace medical, therapeutic or nutritional advice and do not constitute a medical service.

§ 3 Access conditions

Use of the service requires:

  1. Minimum age of 18. By registering, the user confirms that they are at least 18 years old.
  2. Early-access code. During the current early-access phase, a valid access code is required.
  3. Accurate information. All information provided at registration must be complete and correct.

§ 6 Liability

SWADN is liable without limitation for damages resulting from injury to life, body or health, and for damages caused intentionally or by gross negligence.

For damages caused by slight negligence, SWADN is liable only in the event of a breach of a material contractual obligation (cardinal obligation) — an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the user may regularly rely. In such cases, liability is limited to the foreseeable damage typical for this type of contract.

As the service is provided as a beta version, SWADN gives no warranty of uninterrupted availability or freedom from errors.

§ 7 Termination and account deletion

Users may delete their account at any time and without giving reasons. Upon deletion, all stored personal data is irrevocably removed. SWADN may suspend or terminate access in the event of a breach of these Terms.

§ 8 Right of withdrawal for consumers

Consumers have a statutory right of withdrawal. A consumer is any natural person who enters into the contract for purposes that are predominantly outside their trade, business or profession (Section 13 of the German Civil Code, BGB).

Withdrawal instruction

Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded (completion of registration).

How to exercise the right of withdrawal. The easiest way to withdraw is to delete your account yourself — using the account-deletion function in your account settings (“Security” area). Deleting your account constitutes an unambiguous declaration of withdrawal: the contract is terminated and your personal data is irrevocably removed. You do not need to contact us for this.

For a statement by message you may use the model withdrawal form below, although this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you delete your account, or send your declaration of withdrawal, before the withdrawal period expires.

Effects of withdrawal. In the event of a valid withdrawal, we will close your account and unwind the contract. As the service is currently provided free of charge and you make no payment, no costs arise for you from the withdrawal; no compensation for value is owed. We will cease processing your personal data; deletion is governed by our Privacy Policy.

Early commencement of the service. By registering, you expressly request that we begin providing the service before the withdrawal period expires. Your right of withdrawal remains unaffected by this until the period expires.

§ 9 Governing law and jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the user is a consumer with habitual residence in another state of the European Economic Area, the mandatory consumer-protection provisions of that state remain unaffected by this choice of law (Article 6(2) Rome I Regulation).

The place of jurisdiction for all disputes with merchants, legal persons under public law or special funds under public law is Frankfurt am Main. In relation to consumers, the statutory rules on jurisdiction apply.

SWADN is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 10 Changes to the Terms of Use

SWADN reserves the right to amend these Terms of Use with reasonable advance notice. Registered users will be informed by email. Continued use after the objection period has expired is deemed to constitute acceptance.
